TERMS & CONDITIONS AND WAIVER
(Applicable to Fencer Programme, Club Programme, and Essentials Programme)
This Agreement (“Agreement”) is entered into by and between Luca Malvassori, trading as Strength4Fencing (S4F), a self-employed business registered in the United Kingdom, and the purchasing individual (“Client”). Where the Client is the Parent or Legal Guardian of a minor participant (“Participant”), the Client enters into this Agreement on behalf of the Participant.
By completing the purchase and ticking the acceptance box at checkout, the Client acknowledges that they have read, understood, and agree to be bound by the following Terms & Conditions.
1. PROGRAMME DETAILS
- This Agreement applies to the following subscription programmes provided by S4F:
- Fencer Programme
- Club Programme
- Essentials Programme
- These programmes consist of pre-written training plans designed for fencers.
- Programmes are accessed through an online platform and include general support limited to assistance with:
- access to the app,
- payment issues,
- session organisation.
- No video analysis, feedback, or individualised coaching is included in these services.
2. CONFIDENTIALITY AND DATA PROTECTION
- All programme materials are the intellectual property of S4F and are provided solely for the Client’s or Participant’s personal use.
- Redistribution, sharing, or commercial use of the programmes is strictly prohibited.
- S4F may collect and process personal data (e.g., name, email, payment details, account access information) solely for the purpose of delivering the services.
- Personal data will be stored securely and handled in accordance with applicable UK data protection laws and S4F’s Privacy Policy.
- Communications between S4F and the Client will be conducted primarily via email.
3. PAYMENT TERMS
- Payment for all programmes is by subscription.
- The subscription will renew automatically on the same calendar day each month until cancelled.
- All sales are final and non-refundable.
- Failure to complete payment may result in suspension or termination of access to the programme.
4. PROGRAMME USE AND MEDICAL CLEARANCE
- Programmes are provided for personal fitness and conditioning purposes only.
- Clients and Participants are responsible for ensuring that they are medically cleared to engage in physical activity before commencing the programme.
- By accepting these terms, the Client acknowledges the inherent risks of physical activity and assumes full responsibility for participation.
5. INSURANCE AND LIABILITY WAIVER
- S4F maintains fitness insurance coverage that applies to minors and adults worldwide, excluding the United States and Canada.
- This insurance is secondary to the Participant’s personal circumstances and venue conditions.
- Training at home is not covered by S4F insurance.
- When training at a gym, fencing club, or other venue, appropriate insurance must be provided by the venue.
- The Client and/or Parent/Guardian waives all claims against S4F for any injury, accident, or damages arising from participation in the programme, except where prohibited by law.
6. MINORS
- Where the Participant is under 18 years of age:
- The Parent/Legal Guardian must complete the purchase.
- By accepting these terms at checkout, the Parent/Legal Guardian confirms that they have full legal authority to act on behalf of the minor Participant.
- The Parent/Legal Guardian accepts responsibility for the minor’s participation, assumes all associated risks, and agrees to the liability waiver set out above.
7. COMMUNICATION
- All notices, queries, and communications must be sent to S4F by email at the address provided on the website.
- S4F will aim to respond within 48 hours (excluding weekends and public holidays).
8. DISPUTE RESOLUTION AND JURISDICTION
- Any dispute arising under this Agreement will first be referred to mediation before legal proceedings are pursued.
- This Agreement is governed by and construed in accordance with the laws of the United Kingdom.
- The Client submits to the exclusive jurisdiction of the courts of the United Kingdom.
9. ACKNOWLEDGEMENT AND ACCEPTANCE
By completing the purchase and ticking the acceptance box at checkout, the Client (and, where applicable, the Parent/Legal Guardian on behalf of the minor Participant):
- Confirms that they have read and understood this Agreement.
- Agrees to be legally bound by these Terms & Conditions.
- Accepts the Waiver and Release of liability set out above.
